Inside FERC: Crippling Regulatory Uncertainty, Overstepping Seen in Recent FERC Enforcement Actions

The recent spate of high-profile enforcement actions has market players and industry  observers worried that FERC may be overstepping its statutory boundaries in a way that threatens the very health of energy trade. Regulatory uncertainty is another growing concern in this area, according to sources, who maintain that the commission has the regulated industries guessing about exactly what constitutes market manipulation.

Cadwalader partner Gregory Lawrence, is quoted in the Platts publication Inside FERC on December 3rd as saying “The speed at which these rules are coming out is unprecedented, and these are important rules and thus a delay of 18 months is reasonable.” read more
